This LEASE ADDENDUM is made and executed this _______ date of ___________19__ by and between the Housing Authority of the City and County of Hartford (hereinafter "Housing Authority") and __________________________ (hereinafter "Tenant(s)").

WHEREAS, on August 29, 1995 the United States Department of Housing and Urban Development (HUD) instituted the CAMPUS OF LEARNERS initiative; and

WHEREAS, the CAMPUS OF LEARNERS is a residential and education model focused on the goal of equipping residents with the education and employment skills necessary to become self sufficient by integrating modern technology into a structured learning environment; and

WHEREAS, HUD has designated the Charter Oak Terrace as a CAMPUS OF LEARNERS.

NOW THEREFORE, In consideration of the execution of this Lease Addendum and the performance of the covenants, agreement, and conditions by both parties set forth in this Lease Addendum, the parties hereto enter into this Lease Addendum, and the Tenant(s) and all members of the household accept this Lease Addendum on the terms, covenants, and conditions and subject to the promises and provisions set forth below.

I. SPECIAL COVENANTS AND ACKNOWLEDGEMENTS

A The Tenant(s) understand(s) that Charter Oak Terrace has been designated by HUD as an education orientated demonstration development called: the Charter Oak Terrace CAMPUS OF LEARNERS. Charter Oak Terrace is designed to provide individual training and services on site to residents of all ages which will enable them to earn a livable wage.

B The Tenant(s) understand(s) that the Housing Authority is providing housing in the Charter Oak Terrace CAMPUS OF LEARNERS to facilitate the process of self development through training and services by creating an environment where Tenants live, learn, gain employment and buy one of the homes in the Campus of learners or move out of the Charter Oak Terrace CAMPUS OF LEARNERS to other public housing, dispersed housing or alternative housing, depending upon availability.

C The Tenant(s) understand(s) that the family must sign a Campus of Learners Contract of Participation whereby the Tenant(s), and all members of the household, agree to enroll in and successfully complete the provisions of that Contract plan as a condition of living on the campus.

D The Tenant(s) understand(s) that residing on the Campus of Learners is a privilege for him/her/them and the members of the household, not an entitlement or a right.

E The Tenant(s) and any member of the household understand(s) that his/her/their failure, refusal or inability to comply with this Lease Addendum will result in Tenant(s) and all members of the household being transferred to the first available unit, based on family composition, pursuant to paragraph III of this Lease Addendum.

F The Tenant(s) and any member of the household agree(s) to "graduate" or move out of the Charter Oak Terrace CAMPUS OF LEARNERS after a maximum of five (5) years as described in paragraph 2 of this Lease Addendum. The Tenant(s) further understand(s) that the requirement to move out of the Charter Oak Terrace CAMPUS OF LEARNERS is based upon the Tenant's (s") completion of his/her/their Campus of Learners Contract of Participation, and the children's completion of school from kindergarten to twelfth grade or any other member of the household's completion of their individual provisions of the Contract of Participation.

A family will be considered a "graduate" of the Campus of Learners if they buy their own home. Those families who purchase either a single family or duplex unit will no longer be required to be enrolled in the Campus of Learners. Once a home owner, a family will no longer be under the five year rule, and will not be required to move out of Charter Oak Terrace. The family or individual members of the family may continue to participate in the Campus of Learners Program on a voluntary basis, if space is available.

G The Tenant(s) and any member of the household understand(s) that his/her/their acceptance of this maximum five (5) year term limit is a condition of occupancy at Charter Oak Terrace CAMPUS OF LEARNERS in return for the services provided by the Housing Authority set forth in paragraph I, paragraph IV and paragraph VIII of this Lease Addendum.

H The Tenant(s) and any member of the household agree(s) that he/she/they and all members of the household must cooperate with the Charter Oak Terrace CAMPUS OF LEARNERS staff and/or collaborating agencies in assessing needs, establishing goals and in fulfilling all other Charter Oak Terrace CAMPUS OF LEARNERS program requirements.

I The Tenant(s) and any member of the household acknowledge(s) that these conditions and purposes have been fully explained and understood by Tenant(s) at the time of application and at the time of executing this Lease Addendum.

II. OBLIGATIONS

A This Lease Addendum incorporates special provisions regarding Charter Oak Terrace and the CAMPUS OF LEARNERS program, which includes various components. The following is a list of available components that shall constitute the Charter Oak Terrace CAMPUS OF LEARNERS program:

1 Academic and career goal setting and achievement. Tenant(s) and all members of the household shall have an individual Contract of Participation.

2 Full time academic school attendance for all members of the household under age 18.

3 Child development education.

4 Life skills and job skills classes held at prearranged times, on site .

5 Counseling for positive personal change (e.g. self esteem).

6 Computer and telecommunications training classes held at prearranged time, on site.

7 Community Service both on site and in the surrounding Charter Oak Terrace neighborhoods.

  1. Required part time or full time enrollment in academic or vocational education program for the entire period the Tenant(s) and all members of the household live in the Charter Oak Terrace CAMPUS OF LEARNERS.

B. The housing program at Charter Oak Terrace CAMPUS OF LEARNERS is "term limited". Term limited is defined as "providing housing to a tenant and all members of the household for a reasonable, but limited, time period of four (4) years, with a transition period not to exceed a maximum of one (1) year". This five (5) year maximum term limit begins the date this Lease Addendum is signed by the Tenant(s).

The "transition period" is defined as " the time period after the date the Tenant(s) has (have) successfully completed his/her/their individual Contract of Participation not to exceed twelve (12) months. However, in no event shall the Tenant(s) and members of the household live on the campus more than five (5) years. By way of example, and not limitation, if the Tenant(s) successfully complete(s) his/her/their individual Contract of Participation after four (4) years and six (6) months, then the Tenant(s) will have a six (6) month transition period before being required to move out of the CAMPUS OF LEARNERS. By way of example, and not limitation, if the Tenant(s) complete(s) his/her/their individual Contract of Participation after two (2) years, then the Tenant(s) will have a maximum twelve (12) month transition period. The Charter Oak Terrace CAMPUS OF LEARNERS Staff will assist the Tenant(s) with his/her/their job search as well as assist the Tenant(s) in locating other public housing, dispersed housing or alternative housing, depending upon availability.

III NON PERFORMANCE

A If the Tenant(s) refuses or fails to:

  1. participate in the Charter Oak Terrace CAMPUS OF LEARNERS program requirements as set forth in paragraph 7, subsections (a) through (1) below; or

2 successfully complete his/her/their individual Contract of Participation within the time period set forth in paragraph 2 above; or

3 ensure that all members of the household who are under 18 years of age are in an academic education program; or

4 ensure that all members of the household who are over 18 years of age are in a full time or part time academic or vocational education program; such refusal or failure shall constitute grounds for which the Tenant(s) shall be transferred from the Charter Oak Terrace CAMPUS OF LEARNERS to the first available public housing unit, based on family composition. Tenant(s) and all members of the household shall move within thirty (30) calendar days of receiving written notification of noncompliance with the Charter Oak Terrace CAMPUS OF LEARNERS program.

 

B Tenant's(s') refusal to accept the first available public housing unit that meets family composition shall constitute a serious breach of a material term of this Lease Addendum in accordance with 24 C.F.R. 966.4(1) (2) (1) (1996) and shall constitute ground for eviction.

C Tenant(s) is (are) entitled to submit any dispute concerning his/her/their compliance with lease obligations set forth in this Lease Addendum to the Charter Oak Terrace CAMPUS OF LEARNERS Grievance Committee for resolution or decision in accordance with the applicable provisions of the Housing Authority Grievance Procedure.

D If, the Tenant(s) unsuccessfully grieve(s) the Program Manager's decision pursuant to the Housing Authority's Grievance Procedure, the transfer shall occur thirty (30) days after the Tenant(s) receive(s) the Charter Oak Terrace CAMPUS OF LEARNERS Grievance Committee's written decision.

IV NOTIFICATION / UNFORSEEN CIRCUMSTANCES / TENANT (S)

A If, at any time, the Tenant(s) and any member of the household can not complete his/her/their individual Contract of Participation due to circumstances beyond his/her/their control, the Tenant(s) and any member of the household shall notify his/her/their Program Manager, in writing within five (5) days of the occurrence, event or circumstance hindering the Tenant's(s') and any member of the household ability to complete his/her/their individual Contract of Participation. The Program Manager shall determine, in his or her sole discretion, whether the time within which the Tenant(s) must complete his/her/their individual Contract of Participation should be extended. If the Program Manager determines that an extension of time is warranted, the Tenant(s) and any member of the household and the Program Manager will mutually agree upon modifications to the Tenant's(s') and any member of the household individual Contract of Participation which will provide the Tenant(s) and any member of the household with additional time within which to complete his/her/their individual Contract of Participation. In no event shall the extension of time exceed six (6) months.

B No extension of time granted pursuant to paragraph 4 (a) shall be construed as an extension of the five (5) year maximum term limit set forth in paragraph 2 of this Lease Addendum.

C If the Program Manager and the Tenant(s) and any member of the household are unable to agree upon modifications to the Tenant's(s') individual Contract of Participation, then the Program Manager shall determine the appropriate modification, which decision is subject to the Tenant (s) right to appeal the decision through the Authority’s grievance procedure.

D If the Tenant(s) and/or any member of the household require(s) an extension of time exceeding six (6) months, or the Program Manager determines, in his or her sole discretion, that an extension is not warranted, the Tenant(s) and all members of the household shall transfer from the Charter Oak Terrace CAMPUS OF LEARNERS to the first available public housing unit based on family composition. The Tenant(s) and all members of the household shall move within thirty (30) calendar days after receiving written notification of non compliance from the Program Manager if the decision has not been appealed through the grievance procedure.

E Tenant's(s) refusal to accept the first available unit that meets family composition shall constitute a serious breach of a material term of the Lease Addendum in accordance with 24 C.F.R. 966.4 (1) (2) (1) and shall constitute grounds for eviction.

V REQUIREMENTS

From the date of move-in, continued residency shall be based upon the Tenant(s) and all members of the household's participation in the applicable programs listed in paragraph number 1 above and the following program requirements which require the Tenant(s) to:

A Provide documentation showing verifiable full-time/part-time vocational or academic status, for all members of the Tenant's(s) household; and

B Register for and attend a minimum of three (3) no cost Charter Oak Terrace CAMPUS OF LEARNERS life skills classes per month for the first six months; and

C Attend a minimum of one (1) monthly meeting with assigned Charter Oak Terrace CAMPUS OF LEARNERS Staff; and

D Participate in a personal goal setting process with Charter Oak Terrace CAMPUS OF LEARNERS Staff during the first two weeks of residency and agree that the goals must be reasonable in the sole determination of the Program Manager, and

E Participate in goal assessment and revisions on a three (3) month basis; and

F Pursue the goals as defined during these assessments and agree that his/her/their progress, as well as the progress of all members of the household will be monitored by the Program Manager, and

G Agree that the determination of whether the Tenant(s) or any members of the household is (are) in compliance with his / her / their individual Contract of Participation shall be made in the sole discretion of the Program Manager and subject to appeal of the Program Manager’s decision to the Authority’s grievance procedure, and

H Complete two (2) hours each month of community service to the Charter Oak Terrace CAMPUS OF LEARNERS; and

I Complete a Monthly Status Report Form detailing work, academic and volunteer status and provision of appropriate and verifiable documentation of such status; and

J Transfer to another development should the Tenant(s) refuse and/or fail to participate in all applicable program requirements set forth in this paragraph 7 or prescribed by the Program Manager during any given month and/or fail to make sufficient efforts, as determined in the Program Manager's sole discretion, to achieve identified goals over a reasonable period of time; and transfer to another development should any member of Tenant's(s') household refuse and/or fail to participate in all applicable program requirements set forth in this paragraph 7 or prescribed by the Program Manager during any given month and/or fail to make sufficient efforts, as determined by the Manager, to achieve identified goals over a reasonable period of time.

VI THE CHARTER OAK CAMPUS OF LEARNERS STAFF AGREE TO:

A Provide and coordinate vocational/educational/career guidance; and

B Provide and coordinate programs and/or classes sufficient to meet Charter Oak Terrace CAMPUS OF LEARNERS program requirements; and

C Maintain all records to document accountability with the program.

VII TERMINATION OF PROGRAM

The Housing Authority may, in its sole discretion, terminate the Charter Oak Terrace CAMPUS OF LEARNERS program in its entirely or temporarily discontinue any/all services due to lack of funding, reorganization, or other events. If the Housing Authority temporarily discontinues any programs or services, the Tenant(s) will not be held in non-compliance for the period the program are discontinued.

VIII ENFORCEMENT

Failure of the Housing Authority to insist upon strict enforcement of the terms and conditions of any portion of this Lease Addendum shall not constitute or be construed as a waiver or relinquishment of the Housing Authority's right thereafter to enforce the terms and conditions, but the same continue in full force and effect.

IX VALIDITY

If any term, covenant, or condition of this Lease Addendum or the Application thereof to any person or circumstances shall, to any extent, be invalid or unenforceable, the remainder of the Lease Addendum shall not be affected thereby, and each term, covenant or condition of this Lease Addendum shall be enforced to the fullest extent permitted by law.

All other provisions of the Dwelling Lease will remain in full force and effect. However, in the event of conflict between the provisions of this Lease Addendum and the Dwelling Lease, the Lease Addendum shall control.
